General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale (GTCS) govern all relationships between the customer and the SARL MPI-INOX, hereinafter referred to as MPI-INOX, and any natural or legal person making a purchase through the website www.mpi-inox.com.

Article 1 - Purpose

The present General Terms and Conditions aim to define the terms of distance selling between the Seller and the Buyer, from the order to payment and delivery of products or services.

Article 2 - Products and Services

The products and services offered are those listed on the site mpi-inox.com. The Seller strives to present the essential characteristics of the products and services as accurately as possible. The photographs and graphics illustrating the products are not contractual and cannot hold the Seller liable.

Article 3 - Price

The prices of products and services are indicated in euros (€) including all taxes (TTC), excluding delivery charges. The Seller reserves the right to change its prices at any time. Products or services will be billed based on the rates in effect at the time of order confirmation. Delivery charges are indicated before the final confirmation of the order.

Article 4 - Order

Any order placed on the site www.mpi-inox.com implies acceptance of these General Terms and Conditions. The Buyer must follow an ordering process that includes several successive steps:

  1. Product/Service Selection: The Buyer adds the desired items to their cart.
  2. Cart validation: The Buyer checks the selected items and their quantity.
  3. Identification: The Buyer logs into their account or creates a new account.
  4. Delivery method selection: The Buyer selects the desired delivery method and the associated fees are displayed.
  5. Payment method selection: The Buyer chooses their payment method.
  6. Order confirmation: The Buyer verifies all the information of the order and accepts the General Terms and Conditions before proceeding to payment.
  7. Payment: The payment is made according to the terms defined in Article 5.

The confirmation of the order by the Buyer constitutes irrevocable acceptance of the General Terms and Conditions.

Article 5 - Payment Terms

The payment for orders is made by credit card, Visa, Mastercard, American Express, Google Pay, Apple Pay, PayPal, bank transfer, and direct debit mandate. Transactions are secured by SSL Systempay, Stripe, and PayPal.

In the case of payment by bank transfer, the order will only be processed upon receipt of payment in the Seller's account.

Pour les clients professionnels en compte, MPI INOX accorde un délai de paiement aux conditions commerciales définies. (30 ou 45Jours), en cas de dépassement du délai, la société MPI-INOX se réserve le droit d'appliquer des pénalités de retard de 14,25% du montant total TTC.

Article 6 - Delivery

Frais de ports offert à 70€ TTC de commande pour toute commande sur le webshop, et 150€TTC pour commande passée par email ou téléphone.

The products are delivered to the address provided by the Buyer at the time of the order. The delivery times are on average 2 to 5 working days. These times are given as an indication, and any delay cannot give rise to damages, withholding, or cancellation of the order by the Buyer.

In case of shipping delay, an email will be sent to inform you. In case of delivery delay, you have the option to cancel the order under the conditions and terms defined in Article L 216-2 of the Consumer Code.

The transfer of risks occurs at the time of the physical delivery of the products to the Buyer. The Buyer is required to check the condition of the delivered products and to report any anomalies (missing product, damaged package, broken product, etc.) to the carrier and the Seller within 6 days from the date of receipt.

Article 7 - Right of Withdrawal

In accordance with the applicable legal provisions, the Buyer has a period of 14 days from the receipt of the products to exercise their right of withdrawal, without having to provide reasons or pay penalties.

To exercise this right, the Buyer must notify their decision to the Seller by email at info@mpi-inox.com, or via the contact form on the website. The products must be returned in perfect condition and complete, accompanied by the invoice or delivery note, to the following address: MPI-INOX 72 rue Vau de chaume BP 12 41110 ST Aignan France.

The return costs are the responsibility of the Buyer. The refund will be made within a maximum period of 14 days from the date on which the Seller is informed of the Buyer's decision to withdraw, subject to the receipt of the returned products in perfect condition.

Exclusions from the right of withdrawal: In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for certain contracts, in particular:

  • The goods made according to the specifications of the Buyer or clearly customized.
  • The goods that have been unsealed by the Buyer after delivery and cannot be returned for reasons of hygiene or health protection.
  • The audio or video recordings or software when they have been unsealed by the Buyer after delivery.
  • Contracts for the provision of services fully executed before the end of the withdrawal period and whose execution began after the express prior agreement of the consumer and express waiver of their right of withdrawal.

Article 8 - Guarantees

All products sold by the Seller benefit from the legal warranty of conformity (articles L217-4 and following of the Consumer Code) and the warranty against hidden defects (articles 1641 and following of the Civil Code).

In case of non-compliance of a sold product, it can be returned to the Seller who will take it back, exchange it, or refund it.

Article 9 - Responsibility

The Seller's liability cannot be engaged for any damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary issues.

The Seller's liability cannot be engaged in cases of force majeure or events beyond their control.

Article 10 - Personal Data

The Seller commits to protecting the personal data of its Buyers. The information collected during the order is necessary for processing it and managing business relationships. It may be used for commercial prospecting purposes by the Seller, unless the Buyer opposes.

In accordance with the "Data Protection and Freedom" law of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR), the Buyer has the right to access, rectify, delete, and object to the personal data concerning them. To exercise these rights, the Buyer can contact the Seller by email at info@mpi-inox.com.

Article 11 - Intellectual Property

All elements of the site www.mpi-inox.com, whether visual or auditory, including the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of the Seller and its partners.

Article 12 - Disputes

The present General Terms and Conditions are subject to French law. In the event of a dispute, the Buyer and the Seller will strive to resolve it amicably.

In the absence of an amicable agreement, the French courts will have sole jurisdiction. In accordance with the provisions of the Consumer Code regarding the amicable resolution of disputes, the Buyer may resort to mediation services.

Article 13 - Modifications of the General Terms and Conditions

The Seller reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in effect on the date of the order.
